Amairani Thomason Photography - Terms and Conditions

Welcome to Amairani Thomason Photography! By accessing or using our website and services, you agree to be bound by the following terms and conditions. Please read them carefully before booking or using our services.

1. Definitions
     "Client" refers to any individual, couple, or entity who books or utilizes the services provided by Amairani Thomason Photography.
     "Photographer" refers to Amairani Thomason Photography, including its owner, employees, agents, and subcontractors.
   "Services" refers to the photography services offered by Amairani Thomason Photography, including but not limited to wedding photography, engagement sessions, and portrait photography.
   "Agreement" refers to the contract or understanding between the Photographer and the Client as outlined in these terms and any written agreements.

2. Booking and Payment
Booking Fee: A non-refundable booking fee of 25% is required to secure the Photographer’s services for the Client’s specified date. This fee is applied toward the total cost of the services.
Payment Terms: The remaining balance is due 14 days before the scheduled event or session. Payment plans may be arranged upon request.
Late Payment: Late payments may result in additional fees and may delay the delivery of the final images.

3. Cancellation and Rescheduling
Cancellation by Client: If the Client cancels the booking more than 60 days before the scheduled event or session, the Client forfeits the booking fee but will not be responsible for the remaining balance. If the cancellation occurs within 60 days, the Client is responsible for the full payment.
Rescheduling: Rescheduling is subject to the Photographer’s availability. If the Client needs to reschedule, the Photographer must be notified as soon as possible, and a new date will be agreed upon. Additional fees may apply.
Cancellation by Photographer: In the unlikely event that the Photographer must cancel due to illness, emergency, or unforeseen circumstances, a full refund of all payments will be issued, or the Photographer will make reasonable efforts to find a replacement photographer.

4. Event Coverage and Image Delivery
Event Coverage: The Photographer will provide coverage for the agreed-upon time and location(s). Any additional hours or locations may incur extra fees.
Image Selection and Editing: The Photographer will select and edit the best images from the event or session. The final images delivered to the Client will be determined at the Photographer’s discretion.
Delivery of Images: Final images will be delivered within [insert time frame, e.g., 6-8 weeks] of the event or session. Images will be provided in digital format via an online gallery or another agreed-upon method.
Rush Delivery: Rush delivery is available upon request for an additional fee.

5. Copyright and Usage Rights
Copyright: All images and content created by Amairani Thomason Photography are the exclusive property of the Photographer. The Client is granted a personal, non-exclusive, non-transferable license to use the images for personal purposes, such as printing, sharing on social media, and other non-commercial uses.
Commercial Use: Any commercial use of the images requires explicit written permission from the Photographer and may incur additional fees.
Photographer’s Portfolio: The Photographer reserves the right to use the images for promotional purposes, including but not limited to website galleries, social media, marketing materials, and industry competitions, unless otherwise agreed upon in writing.

6. Liability
Limitations: The Photographer’s liability for any claim, loss, or injury arising from the services is limited to the amount paid by the Client for the services. The Photographer is not liable for circumstances beyond control, including but not limited to weather, venue restrictions, or equipment failure.
Indemnification: The Client agrees to indemnify and hold the Photographer harmless from any claims, damages, or expenses arising from the use or misuse of the images.

7. Force Majeure
The Photographer is not responsible for failure to fulfill contractual obligations due to events beyond their control, including but not limited to natural disasters, accidents, illness, or government restrictions.

8. Privacy Policy
Data Collection: The Photographer may collect personal information, such as names, contact details, and event details, to provide services effectively. This information will not be shared with third parties without the Client’s consent, except as necessary to fulfill the services.
Cookies: The website may use cookies to enhance the user experience. Clients can adjust their browser settings to refuse cookies if preferred.

9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of [insert county], Texas.

10. Agreement
By booking services with Amairani Thomason Photography, the Client acknowledges that they have read, understood, and agree to be bound by these terms and conditions.
